Terms of Use
1. Agreement
These Terms of Use are an agreement between you and Codenight LLC (“Codenight”, “we”, “us”), the maker of Tripodia. By downloading or using the Tripodia app or website you agree to these terms and to our Privacy Policy. If you do not agree, please do not use Tripodia.
You must be at least 13 years old (16 in the EEA and UK) to use Tripodia. If you are under the age of majority where you live, you need permission from a parent or guardian, who must agree to these terms on your behalf.
2. The service
Tripodia is a travel guide. It shows places on a map and tells their stories in text and audio, with features such as hands-free listening, walking routes, check-ins and a traveler character, a travel journal, questions about photos, and personal places. Some features need an account, an internet connection, location permission or a paid membership. We keep improving Tripodia, so features may change, and we may add, limit or remove features over time.
3. Accounts
- You can use parts of Tripodia as a guest. To save your progress across devices and to buy a membership, you need an account.
- Give us accurate information, keep your sign-in details secure and tell us if you think someone else has used your account. You are responsible for activity under your account.
- Usernames must not impersonate others or be offensive. We may change or remove a username that breaks these terms.
- You can delete your account at any time in the app (see our account deletion page).
4. Subscriptions and trip passes
Tripodia is free to download. Premium and Premium Plus unlock more features and higher limits, as described in the app at the time of purchase.
- Monthly and yearly subscriptions renew automatically at the end of each period at the then-current price, unless you turn off auto-renewal at least 24 hours before the period ends. Payment is charged to your Apple ID or Google account when you confirm the purchase.
- Free trials. If a free trial is offered, it converts to a paid subscription when it ends unless you cancel at least 24 hours before. If you buy a subscription during a trial, the unused part of the trial ends.
- Trip passes give Premium or Premium Plus for 7 days. They do not renew.
- Managing and cancelling. Manage or cancel your subscription in your App Store or Google Play account settings. Deleting the app or your Tripodia account does not cancel a subscription. If you subscribed earlier on our website, manage it from the link in the app or by contacting us.
- Refunds for purchases made through the App Store or Google Play are handled by Apple or Google under their policies; we cannot issue them directly. This does not affect any rights you have under consumer law.
- Price changes. We may change prices. Apple or Google will tell you in advance and, where required, ask for your consent before a higher price applies to your subscription.
- Restoring purchases. Use “Restore purchases” in the app, signed in to the same account you bought with.
5. Fair use and limits
Generating stories, audio, routes and answers to photo questions costs us real money, so each plan includes limits — for example, a number of new stories per few hours or per day, routes per day, or photo questions per day. The current limits are shown in the app. Check-ins are limited too (for example, a maximum per day and a minimum time between check-ins) to keep the traveler character fair. We may adjust limits, and we may restrict accounts that use automated tools, share accounts at scale or try to get around limits.
6. AI-generated content
Stories, narrations, answers to photo questions and posters are created by AI models from sources such as Wikipedia. We work to keep them accurate, but AI can make mistakes: names, dates and details may be wrong or incomplete, and a photo may be identified incorrectly.
- Treat stories as an enjoyable introduction, not as authoritative historical, legal, medical or safety information.
- Check practical details such as opening hours, prices, access rules and closures with official sources before you rely on them.
- Places on the map may be closed, private, inaccessible or no longer exist.
- If you find a mistake, please report the place in the app.
7. Your safety
Pay attention to your surroundings when you use Tripodia. Do not look at or handle your phone while driving, cycling or crossing a street. Hands-free mode is designed so you can keep your phone away; if you use it while driving, use it only in a way the law allows. Walking routes are suggestions and may not account for traffic, terrain, weather or safety conditions. Respect private property, local laws and the rules of the places you visit. You use Tripodia at your own risk.
8. Your content
“Your content” means what you add to Tripodia: photos, place suggestions, reports, ratings, personal places, journal entries and your username and profile photo.
- You keep ownership of your content.
- You give us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt (for example, resize or crop) and display your content in order to run and improve Tripodia. For content you contribute to public places, such as approved suggestions or place photos, this licence also lets us show it to other users and continues after you delete your account, unless you ask us to remove it.
- You confirm you have the rights to the content you add, and that it does not break the law or anyone else’s rights, including their privacy.
- We may review, decline or remove content, but we are not obliged to monitor everything users add.
9. Acceptable use
You agree not to:
- add content that is illegal, hateful, harassing, sexual, violent, misleading or that infringes others’ rights, or photos that identify people without their consent;
- submit fake places, fake check-ins or false reports, or manipulate your location to gain points;
- scrape, copy or resell our content or data, or access Tripodia through bots or other automated means;
- interfere with, probe or overload our systems, get around security or usage limits, or reverse engineer the app except where the law allows;
- use Tripodia to break any law or to put yourself or others in danger.
10. Our content and third-party data
The Tripodia app, name, logo, design and the stories and audio we generate belong to Codenight or our licensors. We give you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control for your own non-commercial use.
Tripodia uses data from third parties under their licences, including Wikipedia and Wikidata, OpenStreetMap contributors (© OpenStreetMap contributors, ODbL) and OpenFreeMap. Their content stays subject to those licences.
11. Ending your use
You can stop using Tripodia and delete your account at any time. We may suspend or end your access if you seriously or repeatedly break these terms, if the law requires it, or if we stop offering Tripodia. Where reasonable, we will tell you first and give you a chance to fix the problem. If we stop offering Tripodia, we will give reasonable notice. Sections that by their nature should continue — such as the content licence for public contributions, disclaimers and limitation of liability — continue after termination.
12. Disclaimers
To the extent the law allows, Tripodia is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise that Tripodia will be uninterrupted, error-free or available in every location. Some jurisdictions do not allow these exclusions, so they may not all apply to you.
13. Limitation of liability
To the extent the law allows, Codenight will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising from your use of Tripodia. Our total liability for any claim relating to Tripodia is limited to the greater of the amount you paid us in the 12 months before the claim and 50 US dollars. Nothing in these terms limits liability that cannot be limited by law, such as for death or personal injury caused by negligence, or fraud.
14. Governing law
These terms are governed by the laws of the State of New Mexico, United States, without regard to its conflict-of-law rules, and disputes will be heard in the state or federal courts located in New Mexico. If you are a consumer living in the EEA, the UK, Türkiye or another country whose law gives you the right to bring proceedings at home or to rely on mandatory local consumer protections, you keep those rights. Before starting a formal dispute, please contact us — most problems can be solved quickly.
15. App Store and Google Play
If you downloaded Tripodia from the Apple App Store, you acknowledge that these terms are between you and Codenight, not Apple. Apple is not responsible for the app or its content, has no obligation to provide maintenance or support for it, and is not responsible for addressing claims relating to it, including product liability claims, claims that it fails to meet legal or regulatory requirements, consumer protection claims and intellectual property claims; Codenight is responsible for these to the extent these terms say so. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; to the maximum extent the law allows, Apple has no other warranty obligation. You confirm that you are not located in a country subject to a US government embargo or listed on a US government list of restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Apple’s Licensed Application End User License Agreement also applies where it does not conflict with these terms.
If you downloaded Tripodia from Google Play, Google Play’s terms of service also apply to your use of Google Play.
16. Changes
We may update these terms as Tripodia changes. If a change is significant, we will tell you in the app at least 14 days before it takes effect, unless the change is required by law or needed urgently for safety. If you keep using Tripodia after the change takes effect, the new terms apply; if you do not agree, you can stop using Tripodia and delete your account.
